Factory Warrranty Policy

1. Warranty Overview
BENDA MOTO Australia warrants to the original retail purchaser, and any subsequent owner during the warranty period, that each new BENDA motorcycle distributed by BENDA MOTO Australia and sold through an authorised Australian dealer will be free from defects in materials and workmanship under normal use and service for:
  • Two (2) years from the date of first retail registration.
This Factory Warranty applies only to motorcycles originally sold and registered in Australia through an authorised BENDA MOTO Australia dealer.

2. Nature of Warranty
This warranty is a manufacturer’s voluntary warranty provided in addition to statutory rights under the Australian Consumer Law (ACL).

Nothing in this policy limits, excludes, or modifies any right or remedy available under the ACL or any other applicable legislation.

Where a motorcycle or component is found, upon inspection by BENDA MOTO Australia or its authorised dealer, to have a defect in materials or workmanship under normal use within the warranty period, BENDA MOTO Australia will, at its sole discretion and subject to applicable law:
  • Repair the defective component; or
  • Replace the defective component with a new or reconditioned part of equivalent specification.
Repaired or replaced parts may not be identical to original production parts but will meet manufacturer specifications.

3. Warranty Conditions
This warranty is conditional upon:
  • The motorcycle being operated, maintained and cared for in accordance with the owner’s manual;
  • All scheduled servicing being carried out in accordance with manufacturer requirements;
  • The owner retaining appropriate service and maintenance records;
  • The motorcycle not being altered, modified, or fitted with non-approved parts that contribute to a failure.
Failure to comply with these conditions may result in a claim being declined where the non-compliance has caused or contributed to the defect.

4. What Is Covered
Subject to this policy, the warranty covers defects in factory-supplied components including, but not limited to:
  • Engine internal components
  • Transmission and drivetrain components
  • Frame and structural components
  • Factory-installed electrical systems and ECU
  • OEM suspension components (excluding wear items)
Warranty coverage is limited strictly to defects in materials or workmanship.

5. What Is Not Covered
The following are excluded from coverage under this Factory Warranty (except where required under Australian Consumer Law):

Normal Wear and Tear (including but not limited to):
  • Tyres
  • Brake pads and brake discs
  • Clutch friction components
  • Chains and sprockets
  • Batteries
  • Globes and fuses
  • Filters and fluids
  • Spark plugs
  • Cosmetic deterioration consistent with normal use
Routine Maintenance:
  • Scheduled servicing, adjustments, inspections, and consumable replacement items
Damage or Failures Caused By:
  • Misuse, abuse, neglect, or accident
  • Racing, competition, stunt riding, or commercial hire use
  • Improper storage or transportation
  • Overloading beyond manufacturer specifications
  • Use of non-approved fuels, lubricants, or fluids
  • Installation of non-genuine or non-approved accessories
  • Unauthorised modification
  • Repairs performed by unauthorised repairers
  • Failure to carry out scheduled maintenance
External Causes:
  • Environmental exposure including corrosion
  • Fire, flood, storm, or natural disaster
  • Impact damage, vandalism, or theft
  • Cosmetic damage not caused by a manufacturing defect
6. Warranty Claim Procedure
To make a warranty claim, the owner must:
  • Contact an authorised BENDA MOTO Australia dealer as soon as reasonably practicable after discovering the issue.
  • Provide proof of purchase and service history documentation.
  • Make the motorcycle available for inspection and testing.
BENDA MOTO Australia reserves the right to require inspection of the motorcycle or component prior to authorising repairs.

Warranty repairs must be performed by an authorised BENDA MOTO Australia dealer unless otherwise approved in writing.

7. Costs Not Covered
Except as required under the Australian Consumer Law, this warranty does not cover:
  • Transport or towing costs
  • Travel or accommodation expenses
  • Loss of income or loss of use
  • Commercial losses
  • Consequential or incidental damages
8. Transferability
This Factory Warranty is transferable to subsequent private owners within Australia for the balance of the original warranty period, provided the motorcycle has been maintained in accordance with manufacturer requirements.

9. Australian Consumer Law Notice
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

This Factory Warranty operates in addition to, and does not replace, these statutory rights.

BENDA MOTO Australia complies fully with the Australian Consumer Law.

10. Limitation
To the maximum extent permitted by law, BENDA MOTO Australia’s liability under this voluntary warranty is limited to the repair or replacement of defective parts as outlined above.

Nothing in this section limits consumer rights under the Australian Consumer Law.

What is Presidian Extended Warranty?
The Presidian Motorcycle Platinum Warranty is an extended warranty product designed to provide continued protection against certain unexpected mechanical and electrical failures after the expiry of your factory warranty. It is intended to help reduce the financial impact of unforeseen repair costs and provide ongoing ownership confidence.

Key Features
  • Extended coverage period beyond the manufacturer’s standard warranty term (subject to selected plan and acceptance criteria).
  • Mechanical and electrical protection covering a broad range of internally lubricated components and key systems.
  • Nationwide repair network with authorised repairers across Australia (subject to policy terms).
  • Transferable in many cases to a subsequent private purchaser (subject to conditions).
  • Straightforward claims process managed through Presidian, with prior approval required before repairs commence.
What Is Not Covered?
  • Wear and tear items.
  • Routine servicing and maintenance.
  • Consumables such as brake pads, tyres, and clutch components.
  • Damage caused by misuse, neglect, accident, or unauthorised modifications.
  • Failure to maintain the motorcycle in accordance with manufacturer guidelines.
Important Information
The Presidian Extended Warranty is optional and available at additional cost. It operates in addition to, and does not replace, your rights under Australian Consumer Law. All coverage is subject to the specific terms, conditions, claim limits, and approval processes set out by Presidian. Eligibility criteria and underwriting approval may apply.
