1. These terms, and the ones that matter more
These terms cover your use of this website. They are not the contract for buying a motorcycle. If you buy from us, the sale is governed by the New Motor Vehicle Sale Contract you are given and sign, which sets out the price, the vehicle, your rights and ours, and any cooling-off period that applies in your state. Where these terms and that contract differ about a sale, the signed contract wins.
A test ride is governed by the separate test-ride agreement you sign on the day. Our handling of your personal information is covered by our Privacy Policy.
2. We may change these terms
We may update these terms as the site and our services change. The current version is always the one on this page, with the date it took effect at the top. If you have an account, we record which version you agreed to and when — you can see that on your account page. When the terms change materially we'll ask you to agree again the next time you sign in.
3. Information about our motorcycles
We work hard to keep specifications, colours, features and availability accurate, but they can change — manufacturers revise models, and stock moves. Images, renders and configurator previews are illustrative: colours vary between a screen and the real paint, and accessories shown are not always included.
Before you commit, the specification that counts is the one written on your contract. If something on this site matters to your decision, ask us to confirm it in writing.
4. Prices and ride-away figures
Prices are in Australian dollars and include GST unless we say otherwise. A ride-away figure is an estimate: it combines the vehicle price with registration, compulsory third party insurance, stamp duty and statutory charges calculated for the state you choose, using published rates current at the time.
Those rates are set by state authorities and change without notice, and some depend on details we don't know until we have your paperwork. Your final figure is the one on your contract.
In the ACT the ride-away price excludes Motor Accident Injuries (MAI) insurance — the ACT's compulsory third party (CTP) cover — which you choose from a licensed insurer and pay for at registration, together with the levies charged on that policy. Every other state and territory, New South Wales included, has its compulsory third party insurance in the figure shown.
We try to keep the site free of pricing errors. If a price is obviously wrong we are not obliged to sell at it — we'll tell you promptly, and you can proceed at the correct price or cancel and have anything you've paid returned in full.
5. Build & Price
Building a bike on this site produces an indicative quote, not an offer capable of acceptance and not a reserved motorcycle. Not every combination shown can be built, and availability depends on what the factory has scheduled.
6. Placing an order online
When you place an order you pay a $200 order fee by card. That fee secures your place in the order queue and is credited against the purchase price.
Your order is a request, not a completed sale. A sale exists once we accept your order, allocate a specific motorcycle to it and you sign the contract. Until then we may decline an order — for example if the build can't be produced, if stock can't be sourced in a reasonable time, or if we can't verify your details. If we decline, we refund the fee in full.
You may cancel online at any point up to and including the contract stage; once the bike has been delivered it can't be cancelled here. After that stage, talk to us. Refunds of the order fee are reviewed and approved by our team rather than issued automatically — we'll be in touch once yours has been considered. Nothing in this paragraph limits your rights under the Australian Consumer Law.
The balance of your purchase is paid by electronic funds transfer to the account shown on your order. Please quote the reference we give you — it is how we match your payment to your order.
7. Delivery timing
Estimated arrival, shipping and handover dates are our best information at the time and are not guarantees. Shipping schedules, customs clearance and compliance work move. We'll keep you updated through your account, and we'll tell you as soon as we know a date has changed.
8. Test rides
Test rides are subject to availability and to you holding a current, valid Australian motorcycle licence of the right class for the machine. Learner and restricted riders may only ride LAMS-approved motorcycles. We may ask to see and record your licence, and we may decline a ride at our discretion. You sign a separate agreement on the day covering the ride itself.
9. Your account
You sign in with your email address and an access code we send you — there is no password. Keep your access code to yourself: anyone with it and your email address can see your orders, your documents and your personal details. Tell us straight away if you think someone else has it, and we'll issue a new one, which stops the old one working.
Please keep the details on your account accurate. Your address and licence details go on your contract and your registration paperwork, and errors there delay your bike.
We may suspend or close an account that is being used unlawfully, or to attempt access to someone else's information.
10. How you may use this site
Please don't:
- try to access accounts, orders or data that aren't yours;
- probe, scan or test the security of the site, or get around any access control;
- scrape, harvest or bulk-copy content, or use automated tools to place orders or bookings;
- upload anything malicious, unlawful, or that isn't yours to upload;
- interfere with the site's operation or anyone else's use of it.
11. Our content
The text, images, renders, logos and design on this site are owned by us or our licensors, including the BENDA name and marks. You may view, download and print pages for your own use in considering or making a purchase. Anything beyond that — republishing, commercial use, or using our marks — needs our written permission.
If you send us content (a photo of your bike, a review, a message), you keep ownership of it and give us permission to use it in connection with your enquiry, your order and our ordinary business.
12. Other people's sites and services
We link to third parties — finance, insurance, freight, government registries and payment providers among them. We don't control those sites or services, and linking to them isn't an endorsement. Their terms and privacy policies apply when you deal with them.
13. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
For goods, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage, and to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies those rights. Where a term of ours would do so, it does not apply.
14. Warranty
New motorcycles come with the manufacturer's warranty, which starts on the day you take delivery. Its terms, and anything that voids it, are set out in the warranty documentation supplied with your bike. Any extended warranty you buy is a separate product with its own terms. Manufacturer and extended warranties are in addition to your Australian Consumer Law rights, not a replacement for them.
15. Our liability
Subject to section 13, and to the extent the law allows: we provide this website on an as-is basis; we don't promise it will be uninterrupted or error-free; and we are not liable for indirect or consequential loss, or for loss of profit, arising from your use of the site or from information on it.
Where our liability can be limited but not excluded, it is limited — at our option — to re-supplying the relevant service, or paying the cost of having it supplied again.
16. Which law applies
These terms are governed by the law of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them. If part of these terms turns out to be unenforceable, the rest continues to apply.
